Terms of Service

To be eligible for BLU membership and vehicle access, you must:

• Be at least 21 years of age
• Hold a valid driver’s license recognized in New York State
• Pass BLU’s identity and eligibility verification process
• Maintain a valid payment method on file
• Reside or operate within the New York metropolitan area

BLU reserves the right to deny, suspend, or revoke membership at its discretion, including based on driving history, identity verification outcomes, or prior policy violations.

BLU memberships provide access to the platform’s fleet, booking system, and member services. Membership is personal and non-transferable. Sharing account credentials or allowing unauthorized individuals to use your membership is a material violation of these Terms.

Membership fees, billing cycles, and included access are defined at the time of enrollment and may be updated with advance notice. BLU does not guarantee vehicle availability at any particular time. Fleet access is subject to availability, maintenance schedules, and demand.

BLU may offer multiple membership tiers with different access levels, pricing, and included services. Tier features are subject to change; active members will receive reasonable advance notice of material changes to their tier.

Reservations are subject to availability and confirmation by BLU. A reservation is not confirmed until you receive written or in-app confirmation. BLU may decline or cancel reservations due to eligibility concerns, fleet availability, or other operational reasons.

Cancellation policies, including any applicable fees, are presented at the time of booking and apply to each reservation. Late cancellations or no-shows may result in charges as specified in the booking terms. For full details, see our Cancellation Policy.

You agree to use BLU vehicles only for lawful purposes and in compliance with all applicable traffic laws and regulations. Vehicles may only be operated by the verified member who made the reservation. Permitting unauthorized drivers is strictly prohibited.

You may not use a BLU vehicle to:

• Transport passengers for compensation (rideshare, taxi, or similar)
• Participate in racing, speed testing, or off-road driving
• Transport illegal substances or conduct unlawful activities
• Cross international borders without prior written authorization
• Exceed any posted weight or occupancy limits

You are responsible for returning the vehicle on time, in the condition received, with any required fuel level, and with all original equipment. Late returns are subject to additional hourly or daily fees.

You are responsible for any damage to a BLU vehicle occurring during your reservation period, including damage caused by third parties. A damage inspection occurs at pickup and return. You agree to report any pre-existing damage before departing and any new damage immediately upon occurrence.

BLU may charge your payment method on file for damage costs, traffic fines, tolls, parking citations, towing, impound fees, or other third-party charges attributable to your reservation. We will provide documentation of any such charges.

BLU’s chauffeur and private transportation services are subject to driver availability, route confirmation, and applicable New York State livery and transportation regulations. Service areas, vehicle classes, and pricing are defined at the time of booking. BLU is not responsible for delays caused by traffic, weather, road conditions, or events outside our control.

BLU’s personal car maintenance services are performed or coordinated by BLU on your personal vehicle per the service quote accepted prior to work. Service timelines, parts availability, and pricing are subject to change. BLU is not responsible for pre-existing conditions undiscovered prior to service or for delays caused by parts supply or third-party vendors. A signed quote acceptance is required before any work begins.

All prices are in US Dollars. By providing a payment method, you authorize BLU to charge applicable fees including membership dues, reservation charges, damage assessments, fines, and other amounts owed under these Terms.

If a payment fails, BLU may suspend access to your account until the balance is resolved. Disputed charges must be reported to BLU within 30 days of the charge date. Initiating a chargeback without first contacting BLU may result in account suspension.

BLU may suspend or permanently terminate your membership for violation of these Terms, failure to pay outstanding balances, fraudulent activity, unsafe or unlawful conduct, repeated policy violations, or any behavior that poses a risk to BLU, its fleet, or other members. Upon termination, your right to access the platform and vehicles ceases immediately. Prepaid amounts for unused periods may be refunded at BLU’s discretion.

All content, trademarks, logos, platform interfaces, and materials made available through BLU are the exclusive property of Bold Luxury Unlimited LLC or its licensors. You may not reproduce, distribute, modify, or create derivative works from any BLU content without prior written permission. Your membership grants you a limited, non-exclusive, non-transferable license to access and use the BLU platform solely for your personal use in accordance with these Terms.

You agree to indemnify, defend, and hold harmless Bold Luxury Unlimited LLC and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of BLU services, your violation of these Terms, your violation of any applicable law or third-party right, or any damage caused to a BLU vehicle or third party during your reservation period.

To the maximum extent permitted by applicable law, BLU’s total liability to you for any claim arising out of or related to these Terms or your use of BLU services shall not exceed the amount you paid to BLU in the three months preceding the event giving rise to the claim. BLU is not liable for indirect, incidental, consequential, special, or punitive damages. Some jurisdictions do not allow certain limitations, so the above may not apply to you in full.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or your use of BLU shall be subject to the exclusive jurisdiction of the state and federal courts located in Kings County (Brooklyn), New York. You waive any objection to venue or personal jurisdiction in those courts.

These Terms, together with our Privacy Policy, SMS Terms, and any booking-specific agreements, constitute the entire agreement between you and BLU regarding your use of the platform and services. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. No waiver of any provision shall be deemed a further or continuing waiver.

BLU may update these Terms at any time. Material changes will be communicated via email or SMS with reasonable advance notice. Continued use of BLU services after the effective date of updated Terms constitutes your acceptance. If you do not agree to updated Terms, you must discontinue use of BLU and notify us to close your account.
