Terms of Service

To use BLU Services, you must be at least 21 years of age, hold a valid driver’s license in good standing, reside in the United States, and pass BLU’s identity verification and membership screening process. BLU reserves the right to deny membership applications at its sole discretion.

Membership is personal and non-transferable. You may not share your account credentials or allow others to use your account. Verified members remain solely responsible for all activity conducted through their account.

BLU may suspend or terminate your membership at any time for violation of these Terms, fraudulent activity, traffic violations during bookings, failure to maintain insurance requirements, or any conduct BLU determines to be harmful to its members, staff, or fleet.

Vehicle bookings are subject to availability. Confirmed bookings are binding contracts and may be modified or cancelled subject to BLU’s cancellation policy communicated at the time of booking.

When operating a BLU vehicle, you agree to: (a) operate only vehicles for which you have a valid license class; (b) comply with all applicable traffic laws; (c) not operate under the influence of alcohol, drugs, or any impairing substance; (d) not allow any unauthorized driver to operate the vehicle; (e) not transport the vehicle outside the BLU service area without prior written approval; (f) return the vehicle in the same condition as received, normal wear excepted.

You are responsible for all tolls, parking violations, and traffic citations incurred during your booking period. BLU may charge the payment method on file for any such fees, including applicable processing fees, after providing notice.

In the event of an accident, you must: immediately stop the vehicle in a safe location; contact emergency services if required; notify BLU immediately via the platform or SMS concierge; not admit fault to any third party; cooperate fully with BLU’s insurance carrier and legal team.

Membership fees, booking charges, and service fees are charged in United States Dollars (USD). All fees are quoted inclusive of applicable taxes unless stated otherwise.

Payment is processed at the time of booking through the payment method you designate. BLU uses Stripe and PayPal as payment processors. By providing payment information, you authorize BLU to charge fees when due.

Refunds are issued at BLU’s discretion according to the cancellation policy in effect at the time of booking. Membership fees are generally non-refundable. In cases of mechanical failure or vehicle unavailability attributable to BLU, we will issue a credit or refund as appropriate.

BLU may place authorization holds on your payment method at the time of booking. These holds will be released or converted to charges upon vehicle return.

BLU offers USDC stablecoin settlement for qualifying concierge transactions through our VaultPay™ feature, processed via Coinbase Business. USDC settlement is available at BLU’s discretion, subject to eligibility, invite-only access, and applicable regulatory requirements.

You represent and warrant that any cryptocurrency you use for settlement is from a lawful source and that you are authorized to transfer such funds. BLU is not responsible for blockchain transaction failures, network congestion, or price fluctuations after a settlement quote has been issued.

Cryptocurrency settlement does not grant any equity, ownership, governance rights, or any interest in BLU or any related entity. VaultPay™ is a payment mechanism only.

BLU may discontinue cryptocurrency settlement at any time and will provide reasonable notice of any such discontinuation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLU, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

BLU’s total liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the amount you paid to BLU in the twelve (12) months preceding the claim.

The limitations in this section apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if BLU has been advised of the possibility of such damage.

BLU maintains commercial auto insurance covering the fleet during active member bookings. Coverage details, deductibles, and exclusions are provided at the time of membership approval and may be updated annually. By accepting a booking, you acknowledge receipt of applicable insurance disclosures.

You are responsible for any deductible amounts, coverage gaps resulting from your violation of these Terms, and any damages not covered by BLU’s insurance policy.

BLU may offer promotional sweepstakes from time to time. All sweepstakes are subject to official rules published at the time of the promotion. No purchase is necessary to enter or win. Void where prohibited. Sweepstakes open only to legal U.S. residents 21 years of age or older.

Sweepstakes prizes are non-transferable and have no cash value unless explicitly stated. Prize values may be subject to federal and state income tax. Winners are responsible for all applicable taxes.

The BLU platform, logo, brand elements, and all platform content are owned by Bold Luxury Unlimited Auto LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any BLU intellectual property without prior written permission.

You grant BLU a limited, non-exclusive license to display content you submit (such as profile information) solely for the purpose of providing the Services.

You agree not to: (a) use the Services for any unlawful purpose; (b) impersonate any person or entity; (c) attempt to gain unauthorized access to any part of the platform; (d) interfere with the operation of the Services; (e) use automated means to access the platform without permission; (f) resell or sublicense your membership or access; (g) provide false information during account creation or verification; (h) use BLU vehicles for commercial rideshare or delivery services.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction.

YOU AND BLU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

To initiate arbitration, send a written demand to legal@boldluxuryunlimited.com. BLU will provide the AAA demand form and initiation instructions.

BLU may modify these Terms at any time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect. Your continued use of the Services after that date constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your membership before the effective date.
